Sheriff LeRoy Upshaw has announced the arrest of three suspects for the alleged rape and sodomy of a minor child.
The Barbour County Sheriff's Office received a report on February 28, 2012 that a Eufaula child had been sexually assaulted and that there are multiple suspects involved. Sheriff Upshaw assigned Investigator, Lt. David Morris to the case and an investigation began at that time. Sheriff Upshaw said that the case has been worked practically non stop to have these suspects arrested and in jail.
Anthony Wayne Powell, 25 of 618 Old Clayton Rd. Eufaula, AL was arrested on March 14, 2012 and charged with three counts of Rape 2nd Degree. Powell is currently in the Barbour County Jail under bonds totaling one hundred thousand dollars.
James Thomas Wood, 19 of 165 Calhoun Circle Lot 4 Eufaula, AL was arrested March 15, 2012 and charged with two counts of Rape 2nd Degree and one count of Sodomy 2nd Degree. Wood is currently in the Barbour County Jail under bonds totaling forty five thousand dollars.
A fifteen year old minor was taken into custody on March 14, 2012. He was released into the custody of his parent and will be charged with three counts of conspiracy to commit Rape 2nd Degree through the Juvenile Court System.
Lt. Morris said that the alleged rapes occurred in the Eufaula area and that the crimes that began on November 27, 2011. Suspicions were discovered by the grandparent of the child, through writings she had in her bed room and text messages of what was being done to her.
Lt. Morris said that Sheriff Upshaw was briefed daily on the progress of the investigation. When it was determined that enough probable cause was established, the sheriff ordered the suspects be located and arrested. A task force of deputies from all three divisions was established and the suspects were located quickly and taken into custody.
Sheriff Upshaw said that twenty one additional counts of Rape and twelve counts of Sodomy against Powell will be presented to the Eufaula Grand Jury in August for indictments. He explained this was done to prevent the District Court from being bogged down with thirty six preliminary hearings against just one of the suspects.
Morris said that one more suspect is being sought and will be charged with Rape and Sodomy.
